Public Offer

on Concluding a Service Agreement for Submission, Editorial Processing and Publication of Materials in the Scientific Journal

Central Asian Transactions on Materials Structure and Properties

1. General Provisions

1.1. This document is the official public offer of the authorized publisher of the scientific journal “Central Asian Transactions on Materials Structure and Properties” Non-commercial Joint Stock Company “D. Serikbayev East Kazakhstan Technical University”, hereinafter referred to as the Publisher, to conclude a service agreement with any legally capable individual or legal entity, hereinafter referred to as the Author, under the terms set forth in this offer.

1.2. In accordance with the civil legislation of the Republic of Kazakhstan, submission of a manuscript through the journal website, completion of an electronic form, registration on the journal website and/or payment for services related to editorial processing and publication of materials shall be recognized as full and unconditional acceptance of this public offer.

1.3. The agreement shall be deemed concluded from the moment the Author accepts this offer by submitting a manuscript, registering on the journal website or paying for the relevant services.

1.4. By accepting this offer, the Author confirms that they have read, understood and agreed to the terms of this public offer, the publication ethics policy, the privacy policy, the author guidelines and other rules published on the official journal website.

2. Subject of the Offer

2.1. Publisher undertakes to provide the Author with services related to the receipt, editorial processing, organization of peer review, technical preparation and, in the event of a positive editorial decision, publication of the manuscript in the scientific journal Central Asian Transactions on Materials Structure and Properties.

2.2. The Author undertakes to submit the manuscript in accordance with the journal requirements, provide reliable information, comply with the standards of publication ethics and, where an established fee applies, pay for the services in the manner provided for in this offer.

2.3. The Publisher’s services may include:

  1. registration of the Author on the journal website;
  2. receipt and preliminary technical check of the manuscript;
  3. editorial assessment of the manuscript for compliance with the journal’s scope and requirements;
  4. organization of the peer review procedure;
  5. communication with the Author regarding editorial comments and revision of the manuscript;
  6. checking the originality of the text, if necessary;
  7. technical editing, formatting and layout preparation;
  8. publication of the accepted article on the journal website;
  9. publication of article metadata, if necessary;
  10. issuance of electronic confirmation of publication or a certificate, if necessary;
  11. other services related to the editorial and publishing process of the journal.

2.4. Submission of a manuscript and/or payment for services does not guarantee publication. The decision to accept or reject a manuscript is made by the editorial board based on editorial assessment, peer review results, publication ethics requirements and the manuscript’s compliance with the journal rules.

3. Manuscript Submission and Editorial Procedure

3.1. Manuscript submission is carried out through the official journal website https://journals.ektu.kz/catmsp or by another method specified by the Publisher.

3.2. The Author undertakes to provide reliable, up-to-date and complete information when submitting the manuscript, including surnames, first names, patronymics if applicable, affiliations, contact details, ORCID if available and information on the contribution of all co-authors.

3.3. The Author confirms that all listed co-authors have made a substantial contribution to the preparation of the manuscript, have reviewed its final version and agree to the submission of the material to the journal.

3.4. The Publisher has the right to refuse editorial processing or publication of the manuscript if the information provided is unreliable, incomplete, misleading or violates the standards of publication ethics.

3.5. The Publisher has the right to return the manuscript to the Author for revision, correction of formatting, provision of additional information or clarification.

3.6. The Publisher has the right to reject the manuscript at any stage if it does not comply with the journal’s scope, author guidelines, editorial standards, peer review requirements, principles of academic integrity or the legislation of the Republic of Kazakhstan.

4. Cost of Services and Payment Procedure

4.1. The amount of the publication fee, article processing charge, registration fee or other payment related to the journal’s services shall be determined in accordance with the information published on the official journal website.

4.2. Payment shall be made in non-cash form through payment systems, bank details or other payment methods indicated on the journal website or in the invoice issued by the Publisher .

4.3. Payment shall be made in Kazakhstani tenge.

4.4. Bank commissions, payment system fees, currency conversion costs and other deductions by third parties shall be paid by the Author, unless otherwise provided by the Publisher.

4.5. The Publisher has the right to provide payment confirmation documents in electronic form in accordance with the applicable rules and internal procedures.

5. Refund Terms

5.1. Refunds may be made upon the written request of the Author , taking into account the stage of editorial and publishing processing of the manuscript.

5.2. If the Author withdraws the manuscript before the start of editorial processing, the paid amount may be refunded in full, excluding bank commissions and payment system fees.

5.3. If the Author withdraws the manuscript after the start of editorial processing but before the start of peer review, the Publisher has the right to refund part of the paid amount, taking into account the actual expenses incurred.

5.4. If the manuscript has already undergone peer review, editorial assessment, technical editing, layout preparation or other stages of preparation for publication, the paid amount, as a rule, is non-refundable, unless otherwise provided by the legislation of the Republic of Kazakhstan or by a separate decision of the Publisher.

5.5. If the manuscript is rejected due to violation of publication ethics, plagiarism, duplicate publication, simultaneous submission to another journal, fabrication or falsification of data, incorrect indication of authorship, concealment of a conflict of interest or other material violations, the paid amount is non-refundable.

5.6. If the Publisher is unable to provide the paid service for reasons attributable to the Publisher, the refund procedure shall be determined separately in accordance with the legislation of the Republic of Kazakhstan and internal procedures.

5.7. Refunds shall be made within 10 calendar days after receipt of the Author’s written request and all necessary supporting documents.

6. Rights and Obligations of the Publisher

6.1. The Publisher has the right to:

  1. establish and amend the journal’s editorial policy, author guidelines, publication ethics rules and technical requirements for manuscript submission;
  2. make changes to the journal website, the procedure for submitting materials, the publication schedule and the editorial process;
  3. conduct editorial selection, organize peer review, carry out originality checks and technical checks of manuscripts;
  4. request corrections, additional documents, authorship declarations, conflict of interest information and other necessary information from the Author ;
  5. reject manuscripts that do not comply with the journal requirements or publication ethics standards;
  6. engage editors, reviewers, technical specialists, translators, proofreaders, layout designers, indexing specialists and other third parties to provide services related to the work of the journal;
  7. publish article metadata, abstracts, keywords, information about authors and other publication-related information in databases, repositories, indexing systems and on the journal website;
  8. suspend or terminate editorial processing in the event that the Author violates the terms of this offer, publication ethics standards or the legislation of the Republic of Kazakhstan.

6.2. The Publisher undertakes to:

  1. provide services of proper quality within the framework of the journal’s editorial and technical procedures;
  2. organize editorial processing and peer review in accordance with the journal policy;
  3. inform the Author about the main stages of manuscript processing, where possible;
  4. ensure reasonable confidentiality of unpublished manuscripts during the editorial process;
  5. comply with the requirements of personal data legislation;
  6. publish accepted materials in accordance with the journal rules and publication schedule.

7. Rights and Obligations of the Author

7.1. The Author has the right to:

  1. submit a manuscript for consideration by the journal;
  2. receive information about the general status of manuscript processing;
  3. revise the manuscript taking into account the comments of the editorial office and reviewers;
  4. withdraw the manuscript before publication, taking into account the refund terms and editorial procedure;
  5. request correction of technical errors in published materials in accordance with the journal policy.

7.2. The Author undertakes to:

  1. submit an original scientific work that complies with the journal’s scope, author guidelines and publication ethics standards;
  2. ensure that the manuscript contains no plagiarism, unlawful borrowings, fabricated data, falsified results or other forms of academic misconduct;
  3. guarantee that the manuscript has not been previously published and is not simultaneously under consideration by another journal, unless expressly permitted by the journal policy;
  4. correctly indicate all sources, data, images, tables, figures and third-party materials used;
  5. obtain permission to use copyrighted materials, where such permission is required;
  6. disclose information on conflicts of interest, sources of funding, acknowledgements and ethical approvals, where necessary;
  7. provide reliable information about all authors and their affiliations;
  8. respond to editorial requests within the established deadlines;
  9. comply with the rules of professional and academic ethics.

8. Publication Ethics

8.1. The Author confirms that the submitted manuscript complies with generally accepted principles of publication ethics, academic integrity and responsible conduct of scientific research.

8.2. The following actions are not permitted:

  1. plagiarism and self-plagiarism;
  2. duplicate or simultaneous submission of the manuscript to several publications;
  3. fabrication or falsification of data;
  4. incorrect indication of authorship or exclusion of legitimate co-authors;
  5. concealment of a conflict of interest;
  6. manipulation of the peer review procedure;
  7. unauthorized use of third-party materials;
  8. submission of materials that violate legislation or the rights of third parties.

8.3. If there are signs of violation of publication ethics, the Publisher has the right to request explanations, suspend editorial processing, reject the manuscript, retract the published article, notify the relevant organizations and take other measures in accordance with the journal policy and applicable standards.

9. Intellectual Property

9.1. The Author guarantees that they possess the necessary rights to the submitted manuscript and that its publication does not violate the rights of third parties.

9.2. The Author grants the Publisher the right to reproduce, publish, distribute, index, archive, store and place the accepted article on the journal website, as well as in relevant databases, repositories, information systems and indexing platforms.

9.3. Unless otherwise indicated on the journal website, copyright and licensing terms shall be determined by the journal’s copyright policy and the license selected by the Publisher.

9.4. If the journal uses an open access model, the terms of use, distribution and reuse of the published article shall be governed by the relevant license indicated on the article page or on the journal website.

9.5. Use of the journal materials, website content, logos, design elements and other intellectual property objects of the Publisher without written permission is not allowed, except in cases provided for by law or by the terms of the applicable license.

10. Personal Data

10.1. By accepting this offer, the Author consents to the collection and processing of their personal data for the purposes of manuscript submission, editorial processing, organization of peer review, publication, indexing, communication, payment processing, preparation of reports and fulfillment of legal obligations.

10.2. Personal data may include surname, first name, patronymic if applicable, affiliation, academic degree, position, email address, telephone number, ORCID, payment information, correspondence, manuscript metadata and other information necessary for the provision of the journal’s services.

10.3. The Publisher processes personal data in accordance with the legislation of the Republic of Kazakhstan on personal data and the privacy policy published on the official journal website.

10.4. The Author confirms that they have obtained the necessary consent from all co-authors for the transfer and processing of their personal data by the Publisher.

11. Liability of the Parties

11.1. The Parties shall be liable for non-performance or improper performance of their obligations in accordance with the legislation of the Republic of Kazakhstan.

11.2. The Publisher shall not be liable for the inability to submit, revise or publish the manuscript for reasons beyond the Publisher’s control, including technical failures on the Author’s side, incorrect contact details, untimely response to editorial requests or violation of manuscript submission requirements.

11.3. The Publisher shall not be liable for decisions of independent reviewers, indexing databases, repositories, citation systems and other third-party organizations.

11.4. The Author shall be liable for the content of the manuscript, accuracy of data, legality of the materials used, correctness of citation, authorship information and compliance with publication ethics standards.

11.5. In the event of claims by third parties related to the submitted or published manuscript, the Author undertakes to resolve such claims independently and, where there are grounds, compensate the Publisher for losses caused by the Author’s unlawful actions.

12. Force Majeure

12.1. The Parties shall be released from liability for non-performance or improper performance of obligations if such non-performance is caused by force majeure circumstances.

12.2. Force majeure circumstances include natural disasters, fires, epidemics, military actions, acts of government authorities, failures of communication networks, cyberattacks, failures of payment systems and other circumstances beyond the reasonable control of the Parties.

12.3. The Party affected by force majeure circumstances shall notify the other Party within a reasonable period after becoming aware of such circumstances.

13. Final Provisions

13.1. This public offer enters into force from the moment it is published on the official journal website and remains valid until it is amended or withdrawn by the Publisher.

13.2. The Publisher reserves the right to amend the terms of this offer without prior notice. The new version of the offer enters into force from the moment it is published on the journal website, unless otherwise specified in the offer itself.

13.3. All disputes arising in connection with this offer shall be resolved through negotiations. If no agreement is reached, the dispute shall be considered in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
