РЕКОНСТРУКЦИЯ ИСТОРИЧЕСКИХ ОБЪЕКТОВ: БАЛАНС МЕЖДУ НАЦИОНАЛЬНЫМ ЗАКОНОДАТЕЛЬСТВОМ И МЕЖДУНАРОДНЫМИ СТАНДАРТАМИ

Abstract

The article examines the formation of the international legal framework for the conservation and reconstruction of architectural and urban heritage and assesses its influence on the national legislation of the Republic of Kazakhstan regulating the operation and preservation of historical sites. It considers the role of European normative legal acts in conservation and reconstruction matters. Special attention is given to the provisions of the Venice Charter and the documents that complement and develop its principles, adopted by the international community and integrated into national legal regulations. A comparative analysis was conducted of the legislation and urban planning norms of the Republic of Kazakhstan, including the Law “On the Protection and Use of Historical and Cultural Monuments” and relevant international normative acts. General principles and key differences were identified, revealing the “gaps” in Kazakhstani standards, and a SWOT analysis of the interaction between national and international legislation on historical and cultural heritage preservation was carried out. Vectors for future research on improving Kazakhstan’s regulatory framework for historical site reconstruction were determined. The findings facilitate a deeper understanding of the impact of international norms on national legislation and help optimize historical site reconstruction processes moving forward.
